This bill attempts to scale back the State's over reliance on cash bail by creating a presumption of release on recognizance for certain categories of offenses. These exemptions, as written, are too broad and the bills should be amended to limit the scope of these exemptions in order to provide meaningful relief to those who are unjustly detained for reason of not being able to afford cash bail while also protecting public safety. This bill would also convene a penal code review committee to review mandatory minimum sentencing laws and Hawaii repeat offender statute, consider the decriminalization of drug offenses and sentencing alternatives, and make recommendations.
